Eighth Amendment Cognate

  • ALASKA CONST. Art I, § 12. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Criminal administration shall be based upon the following: the need for protecting the public, community condemnation of the offender, the rights of victims of crimes, restitution from the offender, and the principle of reformation.

Immunities

  • AK CONST Art. 2, § 21. The legislature shall establish procedures for suits against the State.
  • AK ST § 09.50.250. Immunity applies when due care has been exercised in: Execution of statute or regulation; Performance of discretionary functions; Assault, battery, false imprisonment, false arrest.
  • AK ST § 09.65.280. State and its officers, agents, and employees are liable in tort when an act or omission that constitutes gross negligence or reckless or intentional misconduct, for damages resulting from communicating with or monitoring the activities of persons on probation or parole.
